The service includes static image generation, animated videos, HD video exports, project organization, version history tracking, and asset management capabilities.

2. AI-Generated Content & Product Improvement

Our service uses AI technology to generate diagrams and animations based on your prompts. By using Diagram Studio, you acknowledge and agree that:

• Content for Service Improvement: We may use anonymized and aggregated data from AI-generated outputs, including prompts, generated scripts, and rendering metadata, to improve and refine our AI models, rendering quality, and overall service performance.
• Usage Analytics: We collect metrics such as token usage, rendering duration, output quality parameters, and error patterns to optimize our service and improve the user experience.
• Model Training: Anonymized prompt patterns and generation outcomes may be used to train and improve our AI systems, resulting in better diagram generation for all users.
• No Personal Data: We do not use personally identifiable information for model training. Any data used for improvement is anonymized and cannot be traced back to individual users.

3. User Content

You retain ownership of the content you create using our service, including:

• Text prompts you submit for diagram generation
• Reference images and assets you upload
• The final generated diagrams and animations
• Projects and organizational structures you create

By uploading content or submitting prompts, you grant us a non-exclusive, worldwide, royalty-free license to use, process, and store your content solely for the purpose of providing and improving our service.

4. Credits and Billing

Diagram Studio operates on a credit-based system:

• Credits are consumed when generating diagrams, animations, and refinements
• Different operations consume different amounts of credits (e.g., static images, animations, HD exports, boost mode)
• A subscription may be required to purchase additional credit packs
• Credits are non-refundable once purchased
• Purchased credits expire 365 days after purchase unless otherwise specified

All payments are processed through our third-party payment provider. You agree to provide accurate billing information and authorize us to charge your payment method for purchased credits and subscriptions.

5. Acceptable Use

You agree not to:

• Use the service to generate illegal, harmful, or offensive content
• Attempt to reverse engineer, decompile, or extract the underlying AI models
• Use automated systems to excessively burden our infrastructure
• Upload malicious files or content that infringes on others' intellectual property rights
• Share your account credentials or allow unauthorized access to your account
• Resell or redistribute generated content in a way that competes directly with our service

6. Service Limitations

You acknowledge that:

• AI-generated content may not always meet your expectations or be technically accurate
• Generation times vary based on complexity and system load
• We do not guarantee 100% uptime or uninterrupted service availability
• Prompts are limited to 25,000 characters and asset uploads are limited per generation
• Failed generations may be automatically retried, consuming credits only on successful completion

7. Data and Privacy

We collect and store:

• Account information (email, name, profile image)
• Generated content, prompts, and version history
• Uploaded assets and reference materials
• Usage metrics and billing information

Your data is stored securely using industry-standard encryption and cloud infrastructure. We do not sell your personal information to third parties.

8. Intellectual Property

The Diagram Studio service, including its AI models, software, branding, and documentation, is owned by us and protected by intellectual property laws. Your use of the service does not grant you any ownership rights to our technology.

You own the rights to the diagrams and animations you create using our service, subject to any limitations of the underlying AI technology and these terms.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. AI-GENERATED CONTENT IS PROVIDED WITHOUT GUARANTEES OF ACCURACY, COMPLETENESS, OR FITNESS FOR ANY PARTICULAR PURPOSE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR USE, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.
